Proposition 64, the Adult Use Marijuana Act (AUMA) was passed in November 2016. California legalized recreational marijuana use for adults 21 years of age and older. The first day of adult-use cannabis sales began on January 1st, 2018, with recreational dispensaries officially open to the public.

Here are some of the regulations regarding cannabis in California:

Consumption

Legal cannabis is not allowed to be consumed in any public place or area, in any location where tobacco smoking is prohibited or within one thousand feet of a school, youth center, or daycare. You are allowed to consume legal cannabis in a private residence, outside of a private residence where not prohibited by the city/county, and within any structures located on the grounds of a private residence that are enclosed and secure from the public.

Cultivation

State residents are permitted to possess and cultivate up to 6 living marijuana plants and only 6 plants are allowed per residence at a given time. Marijuana plants are required to be within a locked space that is not visible by the public. Marijuana products resulting from the plant exceeding 28.5 grams must be secured within the private residence of the grower.

Driving Under the Influence

Driving under the influence of marijuana is illegal and penalties can range anywhere from informal probation, fines, and license suspension to jail time. Penalties become more severe with each conviction.

Exporting Marijuana

Whether driven or sent through the mail, you may not export marijuana across state lines.

Possession

Adults (21 years or older) are allowed to possess up to 28.5 grams of marijuana flower and up to 8 grams of marijuana concentrate. State residents are permitted to possess and cultivate up to 6 living marijuana plants within their private residence.

Purchasing

A valid, government-issued ID allows adults 21 years of age or older to purchase up to 28.5 grams of marijuana flower and up to 8 grams of marijuana concentrate.

Transporting

Legally transported quantities of up to 28.5 grams of marijuana flower and up to 8 grams of marijuana concentrate, must be secured in a child-proof container out of direct reach of the driver. Smoking is prohibited inside of the vehicle, and it is not legal to transport any open package of marijuana products.
